Sortimentor – Terms of Use

Draft – version of 26 October 2026. The English version is binding; the German version is a translation.

1. Provider and scope

1.1 These terms govern the use of the Shopware app "Sortimentor" (the App) provided by PAWSY STAYS, dejavnost spletnih iskalnikov, d.o.o., Prečna ulica 20, 1230 Domžale, Slovenia, registration number 7483040000, tax number (davčna številka) 69658633 (we).

1.2 The App is offered exclusively to businesses (Art. 2 of Directive 2011/83/EU; operators of online shops acting in their trade or profession, the Customer). It is not offered to consumers.

1.3 The App is distributed through the Shopware Store. The purchase, billing, contract term, trial period and cancellation of the App and its paid plans (In-App Purchases) are governed by the terms of shopware AG that apply to purchases in the Shopware Store. These terms govern the use of the App and its service; they are the terms of use agreed for the App in the Shopware Store.

1.4 Customer terms and conditions do not apply, even if we do not object to them.

2. What the App does

2.1 The App imports supplier files (Excel, CSV, text-based PDF) into the Customer's Shopware shop. It proposes how the file's columns map to product fields, shows a preview of all changes, writes the changes only after the Customer confirms them, and can undo an import (rollback) for 30 days.

2.2 The App uses an AI model (provider: see the list of subprocessors) to propose the column mapping and to write short notes on it. AI proposals are marked as such in the App. They are generated automatically and can be wrong, incomplete or inconsistent, even when they sound certain. The same applies to mappings proposed from column names and to the results of price rules the Customer sets up. Proposals and notes are not legal, tax or business advice (e.g. on tax rates or prices).

2.3 Before every import, the App shows a preview of all changes. The Customer checks the mapping and the preview and confirms this by ticking a box before applying the import (acknowledgement). The App warns about some typical mistakes (e.g. a price changing by a factor of 10), but it cannot detect all of them; the absence of a warning does not mean the import is correct.

2.4 Rollback restores the values the App changed and deletes products it created. Values that were edited by hand after the import are kept. Rollback is not a backup: the Customer remains responsible for backing up the shop.

2.5 The Customer remains responsible for the content of their shop, in particular for prices and how they are calculated, tax rates, and the legal requirements for product information and price display towards their own customers (e.g. price indication rules, product safety and labelling information). The App does not check these requirements.

2.6 We may change or replace the AI model or provider, and may switch AI functions off temporarily; the App then proposes mappings from the column names. There is no entitlement to a particular AI model.

3. Plans and limits

3.1 The App has a free plan and paid plans with a monthly limit of products created or updated. The current plans and limits are shown in the Shopware Store and in the App.

3.2 An import that would exceed the remaining monthly limit is not started. Rolling back an import does not restore the limit.

3.3 We may change the free plan's limit with 30 days' notice. Changes to paid plans take effect for the next billing period at the earliest.

4. Availability and support

4.1 The App needs our server. We aim for high availability but do not guarantee it. Maintenance is done outside business hours (CET) where possible. If the App is unavailable, the shop itself keeps working.

4.2 Support is provided by email at [email protected] in German or English on business days. We aim to reply within two business days. Support answers are help with using the App, not a check of the Customer's data.

4.3 The App depends on interfaces of shopware AG and other providers. If they change or fail, functions may be restricted until we have adapted the App. We are not responsible for disruptions we cannot influence (force majeure, failures of networks or third-party services).

5. Customer obligations

5.1 The Customer only uploads files they are entitled to use and that are free of malware.

5.2 The Customer does not try to access other customers' data, overload the service, or circumvent the plan limits.

5.3 The Customer keeps their Shopware administration access secure. Anyone who can open the App in the Customer's administration can import data.

6. Data

6.1 Uploaded files, the import history and rollback data are stored for 30 days and then deleted. Saved supplier profiles (column mappings) are stored until the Customer deletes them or uninstalls the App with data deletion.

6.2 Where we process personal data on the Customer's behalf, the Data Processing Agreement at https://sortimentor.eu/en/dpa/ applies. It is part of these terms.

6.3 We do not use Customer data to train AI models, and our AI provider is contractually bound not to either.

6.4 When the Customer applies an import, we keep a record of what was confirmed (apply log): shop, file name, a checksum of the imported rows, the number of rows and changes, how the mapping was made, the price rule, the safety warnings shown, and the time of the acknowledgement and of any rollback. It contains no file contents. We keep it for three years, also after the App is uninstalled, so that both sides can show what was confirmed in case of a dispute. The Customer can request a copy.

7. Liability

7.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under a guarantee we have given, for fraudulently concealed defects, under mandatory product liability law, and wherever else liability cannot be limited by law.

7.2 Otherwise, for slight negligence we are liable only for breaches of essential obligations (obligations whose fulfilment makes the proper use of the App possible in the first place and on which the Customer may rely), limited to the damage typical and foreseeable for this kind of contract, and in total to the fees the Customer paid for the App in the 12 months before the damage occurred.

7.3 For use under the free plan, we are liable only under 7.1.

7.4 Subject to 7.1, we are not liable for damage resulting from the content of an import the Customer applied after the preview and acknowledgement, in particular from AI proposals, the column mapping, price rules or errors in the supplier file, unless the App wrote something different from what the preview showed.

7.5 Subject to 7.1, liability for lost data is limited to the effort typically needed to restore it had the Customer made regular backups appropriate to the risk.

7.6 Subject to 7.1 and to the extent permitted by law, we are not liable for lost profit, lost sales or other indirect damage caused by slight negligence.

7.7 Where the Customer contributed to the damage (e.g. by not checking the preview or not keeping backups), our liability is reduced accordingly.

7.8 These limits also apply to the personal liability of our managing directors, employees and agents.

8. Changes to these terms

We may change these terms with at least 30 days' notice by email or in the App. If the Customer does not object within that period, the changes apply. We will point out this consequence in the notice. If the Customer objects, either party may terminate.

9. Final provisions

9.1 These terms are governed by the law of the Republic of Slovenia, excluding the UN Convention on Contracts for the International Sale of Goods.

9.2 The courts in Ljubljana have exclusive jurisdiction, to the extent permitted by law.

9.3 If a provision is invalid, the rest of the terms remain valid.
